Smartphones take line 8517.13.00 of the Harmonized Tariff Schedule, in the heading for telephone sets and other apparatus for transmission or reception. Its general rate is Free, and U.S. note 52(b) lists it as exempt from the 60-economy duty. The China lists show None on it in our extract, so $10,000 of smartphones comes to $0 (0%) before fees in this calculator, from any origin. Accessories are not so lucky. Line-telephone handsets on 8517.11 show List 4A: +7.5% for China, machines for receiving and transmitting data on 8517.62 show List 4A: +7.5%, and parts on 8517.79 show List 4A: +7.5%. Phone cases are classified by what they are, in other chapters, and a charger may be a static converter of 8504. So a mixed shipment of phones and accessories needs one line per item, not one code. Why the phone line is so quiet

Two things matter here: a free general rate and a place on the exemption list. Together they leave nothing but customs fees, from any origin the calculator knows. The China Section 301 lists also skip this line, in our extract. A trade action can change that, so check the date on this page.

The rest of the box

Enter each other item separately with the lookup. A chargeable battery may go to the battery lines.

Questions importers ask

Is a phone case classified with the phone?

We read no ruling on phone cases. A case sold on its own is not a telephone, so read the plastics lines of chapter 39 and heading 4202 for your material and design. If it is packed with a phone for retail sale, rule 3(b) of the general rules on goods put up in sets may matter. The rate can differ, because a plastic case line may carry a list duty.

Do refurbished phones pay the same duty as new ones?

Line 8517.13.00 says only “smartphones”, with no split between new and used in its wording, so the used phone meets the same text. Value differs: customs value starts from the transaction price under 19 CFR part 152. On origin, 19 CFR 134.1 looks for a new and different article, so ask your broker or for a ruling if the refurbishing was substantial.

Do smartwatches go on the same line as phones?

We read no ruling on smartwatches. Line 8517.62 covers machines for the reception, conversion and transmission of voice, images or other data, and chapter 91 covers clocks and watches, so a smartwatch raises a question between the two. Search rulings for your model, because the two chapters have very different structures. Rules from other agencies on health claims are not covered here.
